#MyLegalLens @Constitutional Debate On Nigeria As An Islamic State Or A Circular State #legallens By ~ Fame Agidife

Yes, the Sultan is the Head of Islamic religion in Nigeria' and  'the head of traditional rulers as it is stipulated in the 1999 constitution of Nigeria. 

However, Nigeria is not a mono religion State, it is a circular State clearly being being spelt out in the spirit and letters of the constitution as it guarantees the  fundamental rights of all citizens raging from right to life, freedom of movement, freedom of association, freedom of religion etc. 


When a country officially indicated a particular religion in their binding legal document or constitution as 'A' is the religion of Nigeria or 'Orthodux Church of Russia' as is the religion of Russia as is in the case of 'Russia Federation', it means the State officially recognizes that particular religion legally and every other religion outside that particular one is an illegal offshoot or sect that can be proscribed by the leader of the State by a mere 'executive order' as dangerous sect or group to the state any time any day. In other words, every other religious group only exist on the discretion and the political interest of the leader of the state. 

Furthermore, we need to also examine reasons countries adopt one religion as State religion, which are clearly based on fears of foreign influence through citizens' religious inductrination against nation's cultural heritage and foreign control through religious influence. 


However, Nigeria do not have any of such peculiarities in our precolonial independence era.  


Suffix to this are the fact that Nigeria was not founded by any religious group and we should not forget hastily that the founding fathers of Nigeria were people from divers religious background counting from the great Zik of Africa a Christian, Sultan Amadu Bello a Muslim, Alhaji Sir Abubakar Tafawabalewa a Muslim, Chief Bar. Jeremiah Awolowo a Christian & traditionalist and chief Festus Omimi Okotie-eboh a traditionalist and etc. 

So, when some are to argue on the letter and the spirit of the current 1999 constitution as to whether it altar our foundation as aforementioned above as a nation, then I put it to such ones that the 1999 constitution is just more  of a copy and paste version of 1979 constitution being berthed by the 1975 constitutional conference headed by a  southerner the great chief Rotimi Williams (the Law) himself, under the constitutional conference which chief Obafemi Awolowo refused to served as a member under chief Rotimi Williams as chairman for the reason being that he as a member of the founding fathers of the country cannot accept to serve under chief Rotimi Williams the Law.


So, in conclusion, it's very clear that if Nigeria is a Muslim state as some often opined, we will not have equal freedom of religion and most critically as it's more common with Islamic States, our constitution would have been modeled on the sharia laws unlike what we have today that's being copied or modeled after the American constitution by chief Rotimi Williams the Law.
